What is the loophole, you ask?

Two words. Downgrade rights.

It seems that a number of computer manufacturers including Dell and HP will offer you the option, at the time you order your new PC, to exercise your downgrade rights. They log a Vista Professional or Ultimate sale, but install XP for you so that you don't have to do it yourself.

Lenovo is said to be installing Vista but including an XP recovery disk so that owners can more easily take advantage of their downgrade rights.

You listening, Steve? The market has spoken.

Another way to tell is to check the prices of various flavors of Windows on eBay. Win2K is available in the $10-50 range, XP pro goes around $100-125 about the same as Vista.
I would call that "the market speaking".

We buy Vista licences (hey you never know...) and immediately replace the install on delivery with XP+sysprep key. I'd love to see MS' Vista sales numbers vs completed Vista activations.
